이주노동자에 대한 집중 단속을 즉각 중단하라!
8월 1일부터 우리 이주노동자들에 대한 집중 단속이 시작됐다.
우리는 매일 우리의 친구, 동료들이 공장, 길거리, 집에서 단속에 걸려 잡혀갔다는 소식을 듣고 있다.
정부는 이제는 적법 절차를 지켜 '인권 침해 없는' 단속을 하겠다고 말하고 있다.
그러나 우리는 이번에도 단속반이 공장 등의 건물에 들어갈 때 영장을 제시했다거나, 이주노동자들에게 보호명령서를 제시했다는 얘길 한 번도 듣지 못하고 있다.
사실, 단속 자체가 우리의 인권을 심각하게 침해하고 있다. 우리는 단속의 공포 때문에 자유롭게 돌아다니지도 못하고, 단속이 되면 감옥 같은 수용소에 갇혀 체불 임금이나 퇴직금이라도 받을라치면 끔찍한 수용소 생활을 감내해야 한다.
우리는 범죄자도 아닌 데 법원의 허가도 없이 구속이 되고, 정당한 재판을 받을 권리조차 제대로 부여받지 못한다. 이보다 더 심한 인권 침해가 또 있는가?
한국 정부는 법 질서 확립과 치안을 위해 우리를 단속해야 한다고 말한다.
그러나 우리 이주노동자들은 한국의 법질서를 문란하게 하는 집단이 아니다. 우리는 오히려 우리가 가난한 나라 출신 외국인이라는 이유로 차별을 정당화하는 법 제도들로 인해, 그리고 법의 사각지대에서 온갖 권리를 침해당하고 있다.
정부는 우리와 동료들이 많이 거주하는 지역을 '불법 체류자 밀집 우범 지역'이라고 말하며 마치 우리가 범죄 집단인 것처럼 묘사한다.
그러나 우리 대부분의 이주노동자들은 한국의 법과 제도를 잘 몰라 실수를 할지라도 매사 조심스럽기 그지없다. 오히려, 범죄 피해를 당해도 변호사의 조력도, 경찰의 도움을 받기도 쉽지 않아 그냥 넘어가는 경우가 비일비재하다.
한국 정부는 우리가 한국인 노동자들의 일자리를 위협한다고도 말한다. 그래서 한국 노동자들의 일자리를 지켜주기 위해 우릴 내쫓아야 한다고 말한다. 그러나 우리는 한국 정부와 기업들이 얼마나 많은 비정규직을 양산해왔는지를 봐왔다. 지금 한국에는 무려 850만의 비정규 노동자들이 있다. 심지어 비정규직 일자리라도 지키겠다고 파업을 벌이는 이랜드 노동자들을 한국 정부가 어떻게 대하는 지를 보고 있다. 우리는 한국 정부가 정말로 한국 노동자들의 일자리를 보호하려고 하는지 의심스럽다.
정부가 정말 한국인 노동자들의 일자리와 임금을 걱정한다면, 우리에게 한국 노동자들과 같은 노동 조건과 권리를 부여해야 한다. 그래야 우리는 저임금에 혹사당하지 않을뿐만 아니라, 기업주들이 한국 노동자들의 임금과 일자리를 위협하는 집단으로 우릴 앞세우지 못할 것이다.
강조하건대, 우리는 한국 사회의 짐이 아니다. 우리는 이 사회가 돌아가게 만드는 여러 톱니바퀴들 중 한 부분을 차지하고 이 사회의 지속과 발전에 기여하고 있다.
따라서 우리는 필요할 때 실컷 쓰다 언제라도 갖다버리는 일회용품처럼 우리를 취급하는 것을 받아들일 수 없다. 우리를 범죄자로 몰아 인간사냥하듯 한국에서 추방하는 이 야만적 정책에 동의할 수 없다.
한국 정부는 즉각 이주노동자 단속을 중단하라!
우리 이주노동자들이 인간답게 살 수 있는 권리를 보장하라!

Migrant Workers' Joint Statement
Stop the Concentrated Crackdown against Migrant Workers Immediately!
A concentrated crackdown against migrant workers began on August 1.
Everyday now we hear news of our friends and colleagues being caught in factories and homes and on the street.
The government says this time it will use legal procedures to carry out the crackdown in such a way that human rights violations do not occur.
However, now, as in the past, we do not hear of a single instance in which crackdown officers present a warrant before entering a factory or other building, nor of a single case in which they present a detention order before arresting a migrant worker.
In fact, the crackdown, by its very nature can be nothing other than a serious violation of our human rights. Because of the announcement of the crackdown we cannot move about freely; if we are arrested we end up living miserable lives in detention centers that are no better than prisons, unable to even think about receiving back-wages or severance pay that is due to us.
Although we are not criminals at all, we are arrested with out permit from a court of law and are not even given the right to a fair trial. Is there really a more serious violation of human rights than this?
Despite the way the government treats us, we migrant workers are not a threat Korean society. Rather we are the ones who suffer every sort of human rights violation because of blind spots in the law and a system which justifies discrimination against us because we are foreigners from poor countries.
The South Korean government calls areas where our colleagues live ‘concentrated illegal resident areas susceptible to crime' designating us a criminal class.
However, the majority of us, although we my make small mistakes because we do not know the law, are endlessly careful. In fact, if we become victims of crime it is very difficult for us to get assistance from a lawyer or the police. Very often we must simply let the issue pass while suffering the consequences.
The Korean government says that we are a threat to the jobs of Korean workers. It therefore says it must expel us from country in order to protect these jobs. However, we can see easily how many irregular jobs the government and businesses have been creating. Right now, there are no less than 8,500,000 irregular workers in South Korea. In addition, we can see what the government is doing to the Eland workers who are carrying out a strike to protect there irregular jobs. We seriously doubt if the government really intends to protect Korean worker.
If the government is really concerned about Korean workers jobs and wages it must provide us with the same work conditions as they have. This is the only way to assure not only that we are not exploited as cheap labor but also that employers cannot use us to tame labor by calling us a threat to Korean workers’ jobs and wages.
We must emphasize that we are not a burden to Korean society. We are part of the wheels that make this society turn and are contributing its maintenance and development.
Therefore, we cannot accept being treated like disposable goods that can be used to heart’s content when needed and discarded at will. We cannot accept the deportation policy of the Korean government which is none other than a manhunt against us.
The Korean government must:
-stop the crackdown against us immediately and protect our right to live as human beings!
-Legalize all Migrant Workers!
