As you already know, yesterday they deported Samar! Until now he’s still detained in police education center (actually a case to worry…). Our last information: because Korean “authorities” deported him without his Nepalese passport. So Nepalese “authorities” were not clear about his nationality, but Samar’s father brought a document that proofs that Samar is his son and consequently Nepalese citizen. So when all formalities are finished today they will release him immediately. Like that is our last information from Samar’s family.

First of all, as we already said weeks before, the government should keep in mind: What is not killing us, just it made us stronger!
But anyway the current situation is a very serious situation and it shows our limitation. While government’s policy of mass deportation is failing – in contradiction, instead of 120.000 undocumented migrant workers (mw) in Nov last year, now there are 15o.000 “illegal” mw here and in at least three month 200.000 “illegal” mw will live here – government’s policy of repression against us partly is “successful”, or better said: in parts we are not able to achieve properly what we demanded. This is just the reality! (IT DOESN”T MEAN THAT WE WILL GIVE UP, NOT AT ALL!!!) And the reality just is the proof of our opinion we every day repeat: the government has no power to hunt, detain and deport all “illegal” mw, because they are masses. Immigration and police only can act against individuals, not against masses of individuals, because government’s means, like places in detention centers, the number of immigration officers etc, are limited. We, MSSC and the mw activists in the different regions, are not separated individuals, but also not masses. And this is our weakness: we have strong determination, but our number is small. As you know: if we would not have such a strong solidarity from the side of Korean workers and student activists, immigration and riot cops already would arrest us all. Just the reality! And already they were trying to catch us all! Perhaps you remember Feb 22, our rally and demo to celebrate 100 days sit-in struggle? They thought 1.000 combat riot cops would be enough to break up our rally and capture us all, but thanks to 900 mw, Korean student activists and unionists, on the end they had to give up their plan. But not every time we can count on the solidarity of our Korean comrades – we have to build our own power, otherwise we can’t achieve our goal. Today’s reality lectures us something very important, we just have to internalize it and to act properly! Then, we are sure, we will be able to reach our goal! Otherwise, just we will lose!
Yesterday we’d two rallies in Myeong-dong protesting against Samar’s deportation. The atmosphere of the first one, in the afternoon, was characterized by deep sadness. But surprisingly the second, the evening rally, even it was raining cats and dogs, was so powerful! About 300 people gathered on our struggle place and promised never to give up solidarity with us, the struggle and to organize us better than ever. Mahbub, a comrade from Bangladesh said later with full enthusiasm: “This day brought us a new and stronger unity in our struggle collective!”

명동성당 이주농성단 대표 샤말 타파 전격 강제출국 규탄
민주노총과 약속 파기... 노정 대화 기조 재검토 할 것
1. 정부가 외국인보호소에 수감중이던 명동성당 농성당 대표인 네팔노동자 샤말 타파 평등노조 이주지부장을 오늘(4월 1일) 전격 강제출국 시켰다. 민주노총은 이같은 조치를 반인권적, 반노동자적인 만행으로 규정하고 강력하게 규탄한다.
2. 특히 3월 23일 민주노총 위원장과 국무총리 면담시에 "문제해결을 위한 진지한 대화"를 하겠다고 약속했고, 이에 따라 바로 3월 30일 법무부 출입국관리국장과 총리실, 노동부와 민주노총이 실무협의를 진행하여 보호일시해제 등을 검토하겠다고 약속한 직후에 발생한 이같은 전격적인 출국조치에 민주노총은 분노를 금할 수 없다. 강제 출국 하루전인 3월 31일에도 법무부에서 보호일시해제 문제에 대한 검토를 위해서 민주노총에 관련 자료를 요청해왔고, 이에 임금체불 관련 민사소송 관련 자료를 법무부에 제출한 바가 있다. 민주노총은 이같은 법무부와 정부의 민주노총 기만행위를 도저히 묵과할 수 없다.
3. 법무부는 지난 2월 14일 이주노동자 문제 등을 협의한 민주노총 위원장과 법무부장관 면담 바로 다음날은 2월 15일 샤말 타파를 납치하듯이 강제 연행한 바 있다. 이주노동자 관련 문제만이 아니다. 민주노총과 대통령 면담시 약속했던 현대중공업 사내하청 박일수 노동자 분신자결 사건에 대한 정부와 민주노총의 공동조사도 결국은 현대중공업을 제외한 다른 조선업체에 대한 조사로 변죽만 울리고 있다. 우리는 모든 문제를 대화로 풀어나가려고 적극적으로 노력해왔다. 그러나 대화는 약속이행과 신뢰의 바탕이 없으면 아무 의미가 없다. 민주노총은 샤말 타파의 강제출국에 접해 정부와 대화기조를 근본적으로 재검토할 것이다. 이에 대한 모든 책임은 약속을 파기하고 민주노총을 기만한 정부에 있음을 분명히 한다.
4. 샤말 타파 대표는 지난해 정부의 이주노동자 강제추방정책 철회와 이주노동자 전면합법화를 요구하며 지난해 11월 15일부터 현재까지 진행되고 있는 이주노동자들의 명동성당 농성을 이끌어왔다. 이 과정에서 지난 2월 15일 출입국관리소 직원에 의해 강제연행되어 출국전까지 여수외국인보호소에 수감중이었다. 수감중 연행 이주노동자 석방과 강제추방 중단, 전면합법화를 요구하며 다른 이주노동자들과 함께 31일간 단식을 전개했었다. 최근 들어 미등록이주노동자("불법체류자")는 더욱 급증해 정부 통계에서만도 15만명에 이르고 있다. 정부 정책의 실패가 현실에서 드러나고 있는 것이다. 그러나 정부는 오로지 단속추방만 외칠 뿐 강제추방을 중단하고 제도를 합리적으로 개선하는 데 대해서는 눈과 귀를 닫고 있다. 그 결과는 이주정책의 참담한 실패로 되돌아 올 것이다. 이주노동자 정책에 대한 근본적인 수정이 없으면 민주노총은 이주노동자와 연대하여 이주노동자의 노동권 보장과 합리적인 이주정책 쟁취를 위해 온 힘을 다해 투쟁할 것이다.
