선거관리위원회 선거 규정
1. <목적>
이 규정은 민주노총 서울지역본부 평등노조 규약 제 63조에 의하여, 평등노조 이주노동자지부 임원 및 대의원 선거에 필요한 사항을 규정함을 목적으로 한다.
2. <선거권>
1) 선거권은 결의권을 갖는 평등노조 이주노동자지부 모든 조합원에게 있다.
3. <피선거권>
선거권자의 자격과 같다.
4. <선거관리위원회의 구성>
선거관리위원회는 각 분회에서 파견된 위원과 지부 임원 중에서 3인 이상으로 구성한다.
5. <선거관리위원회의 임기>
현 위원의 임기는 위원회는 평등노조 이주지부 제 2기 임원 선거 종료 후 익일 결과 공지 시까지로 한다.
6. <선거관리위원회의 기능>
선거관리위원회의 기능은 다음과 같다.
① 입후보자의 등록추천장 수리 및 자격심사
② 선거인명부 작성
③ 참관인 신청 등록
④ 투개표 관리
⑤ 선거운동 방식 결정과 보고
⑥ 등록업무 및 투개표 업무를 위하여 필요한 사항
7. <의결정족수>
재적 조합원 50%이상이 투표에 참여하고 투표참여 조합원 과반수 이상 찬성을 득했을 때 의결한다. 당선자는 최대 다수 득표자가 된다.
8. <선거관리위원회 운영에 관한 협조>
평등노조 이주노동자지부는 이 위원회에서 선거사무에 대한 협조요구가 있을 때 응하여야 하며, 선거사무에 관한 제 비용은 평등노조 이주노동자지부 재정으로 부담한다.
9. <후보자 등록절차>
각 선거에 대하여 선관위는 후보 등록 일시를 정하고 선거일 15일 전에 공고한다. 단, 대의원 선출에 대하여서는 선거일 즉석 추천도 가능하다.
입후보 희망자는 선거관리위원장으로부터 양식을 교부받고 필요한 제반 서류를 갖추어 선거관리위원장에게 선관위가 제시한 마감일까지 제출한다.
10. <입후보등록 요건>
1) 임원 : 입후보자는 다음 각 호의 서류를 선거등록 마감일까지 선거관리위원장에게 제출하여야 한다.
① 선관위가 정한 이력서 1통
② 조합가입서 사본 1통
③ 조합원 10% 이상의 추천서 1통
④ 사업계획서(공약) 1부
2) 대의원 : 선거관리위원회가 정하는 바에 따라 한다.
11. <입후보의 취소>
1) 선거관리위원회는 입후보 등록 마감 후 이 규정에 의거하여 자격을 심사하고 다음 각 호와 같은 결격사유가 있을 경우 후보등록을 취소할 수 있다.
① 등록서류의 허위기재한 사실이 밝혀졌을 때
② 선거관리위원회가 불법 혼탁 선거운동으로 지적하여 자격박탈을 결의하였을 때
③ 입후보자가 직접 사퇴 의사를 밝혔을 때
2) 이때에 선관위장은 지체없이 공고문을 수정하고 전 조합원에게 이를 알린다.
12. <입후보자의 공고 및 기호>
선거관리위원회는 입후보자 기호와 이력사항을 공고문으로 제작하여 등록마감일 다음날 즉시 평등노조 이주노동자지부 사무실에 부착하고 각 1부 씩 분회장에게 배포한다.
선거관리위원장은 입후보자가 등록한 순서대로 기호를 부여한다.
13. <선거운동>
선거운동기간은 후보등록 마감일 다음날부터 선거일 하루 전까지로 한다.
14. <선거운동의 제한>
입후보자와 그 운동원은 다음 각 호의 행위를 제외하고는 자유로이 선거운동할 수 있다. 단, 선거관리위원회는 이 규정에 의거하여 선거운동의 제한을 가할 수 있다.
① 지정한 선거운동기간 위반
② 포스터 사용 및 부착
③ 조합원들에게 불쾌감을 주거나 분열을 조장하는 행위
④ 비방 혹은 인신공격
⑤ 금품제공
⑥ 민주노총 조합원으로서의 명예를 실추시키는 행위
15. <선거인명부 작성 및 공람>
선거관리위원회는 선거인 명부를 확정, 작성한다. 선거관리위원장은 입후보등록을 마친 입후보자가 선거인 명부 공람을 원할때에는 즉시 공람시켜야 한다. 단, 선거인명부를 가져가거나 복사할 수 없다.
16. <투표장소 및 시간>
투표소와 투표시간은 각 선거시기에 선관위가 지정한 장소로 한다.
17. <참관인>
선거관리위원장은 분회장 입후보자가 지명한 참관인으로 하여금 투개표 과정을 참관하도록 하며, 참관인은 각 후보자마다 1명 이내로 제한한다.
18. <유권해석과 통상관례>
본 규정에 대한 해석은 선거관리위원회가 한다. 본 규정에 미비되어 있는 사항은 선거관리위원회가 협의하여 통상관례에 따른다.
19. <시행기간>
본 규정은 정해진 날로부터 시행한다.
Election administration commission (EAC) Rules
1. <Purpose>
This rule will fix the necessary things for fair election of ETU-MB officers and representatives according to ETU rules & regulation article 63.
2. <Voting rights>
1) Every ETU-MB members who have a decision rights have a voting rights.
3. <Candidacy rights>
It's same with the condition of voting rights.
4. <Composition of EAC>
EAC composed over 3 members from sent respective chapters and MB officer.
5. <Period of EAC>
The period of EAC will be closed until notice the winner on following day after finish the election of ETU-MB officer.
6. <Function of EAC>
① Receive the registration of candidacy and examine the candidates
② List-up the voters
③ Accept the voting witness for voting and the ballot-counting
④ Manage the voting and ballot counting
⑤ Decide the rules and report of election campaign
⑥ The others for the registration, voting and ballot counting
7. <The fixed number for decision>
Decision can be fixed when 50% of voters join the voting and achieve over 50% supporting of attendance. winner is highest achieving person.
8. <Cooperation for managing of EAC>
ETU-MB has to help EAC if they appeal the demands. Election budget for managing will be provided form ETU-MB.
9. <Registration of candidacy Process >
EAC have to decide the registration day and notice it before 15 days of election day. However, Representative election can be nominated by recommendation on election.
The candidate has to receive the application form from chairperson of EAC and submit it with all needed documents to him/her.
10. <Condition for Registration of candidacy>
1) Officer : candidate have to submit the below things to Chair person of EAC until last register day.
① A copy of Profile which from EAC
② A xerox copy of members application
③ A letter of recommended candidate of over 10% of memebrs
④ A copy of public pledge
2) Representative : candidate have to follow EAC's decision.
11. <Cancellation of candidate>
1) EAC can decide the cancellation if it has reasons for disqualification like below things when they examine the candidate after finished the registration according to this rules.
① When approved the lie on the application form
② When EAC decide the cancel of registration because of unfair or irregular practice campaign
③ When candidate appeal waiver him/her self.
2) EAC chairperson has to adjust the pubic notice and announce to all members
12. <Notice and give the number of candidate>
EAC have to make the public notice with the candidate number and profile, EAC post it on ETU-MB office after 1day of the last date of registration. And EAC have to gove the 1 copy to respective chapter chief.
EAC chairperson has to give the candidate number according to priority
13. <Election Campaign>
Election Campaign period is start from after 1day of the last date of registration until 1day before election day.
14. <Restriction of Election Campaign>
The candidate and campaigner can do free without below things. However, EAC can restrict the campaign according to this below things.
① Breach the election campaign period
② Use or post the poster
③ Act of division or displeasure against members
④ Personal attack or abusing
⑤ Provide the money and other valuables
⑥ Act against KCTU members' honor
15. <List up and showing of the voters' list>
EAC have to fix the voters' list. EAC chairperson has to show this list for candidate who finished registration if he/she wants. However, candidate can't bring or xerox copy it.
16. <Voting place and time>
Voting place & Voting time will be decided by EAC on respective election.
17. <Voting witness>
EAC chairperson has to accept the voting witness for monitor the voting and ballot-counting process who was suggested from candidate of chapter chief. Candidate of chapter chief can suggest only 1 person for the voting witness.
18. <Authoritative interpretation and usage>
The analysis of this rule can be decided by EAC. If it has not enough things, EAC have to follow custom.
19. <Period of effectiveness>
This rule has effectiveness from decided day.
