최근 단속 상황 및 문제 사례
1) 수원출입국관리소 이주노동자 폭행 사건

경찰이 피의자에게 가혹행위를 해 물의를 빚고 있는 가운데 법무부 출입국관리소 직원이 중국인 불법체류자에게 수갑 등으로 폭력을 휘두른 사실이 뒤늦게 밝혀졌다.
29일 법무부와 경기도 수원출입국관리사무소에 따르면 지난 9일 오후 8시 30분쯤 경기도 수원시 영통구의 출입국사무소 4층 외국인보호실에서 직원 A(52)씨가 중국인 불법체류자 윤모(48)씨를 폭행했다는 인터넷 민원이 접수돼 관계 당국이 감찰이 벌이고 있다.
A씨가 폭행을 휘둘렀을 당시 외국인보호실에는 윤씨를 포함해 중국인 불법체류자 8명이 조사를 받기 위해 대기하고 있었다.
윤씨는 법무부 등이 실시한 조사 과정에서 출입국 직원 A씨가 외국인보호실로 들어와 자신의 배를 걷어차고 수갑으로 얼굴과 등을 때렸다고 주장했다.
이에 출입국사무소측은 A씨가 윤씨를 폭행한 사실을 상당 부분 인정했다. 출입국사무소 관계자는 "A씨가 윤씨를 폭행한 사실은 맞다"며 "연행 당시 윤씨가 (우리)직원들에게 깨진 병을 휘둘렀다는 얘기를 전해 듣고 나무라다가 벌어진 일"이라고 해명했다.
윤씨 등은 경기도 수원시 영통구 인근의 한 식당에서 신고를 받고 출동한 출입국관리사무소 직원 6명에게 붙잡혀 연행됐다.
그러나 연행 도중에 윤씨 등이 각목과 깨진 병을 들고 격렬히 저항했으며 이 과정에서 출입국 직원 한 명이 손가락 인대가 늘어나는 등 다친 사람이 있었다고 출입국 사무소 측은 설명했다.
법무부와 출입국관리사무소는 A씨로부터 이미 사표를 받고 강도 높은 감찰을 벌이고 있으며 자체 진상 조사 결과에 따라 수리 여부를 결정할 방침이다.
출입국 사무소측은 특히, 이번 사건이 자칫 외교 문제로까지 비화될 수 있어 당혹감을 감추지 못하고 있는 것으로 알려졌다.
이와 관련해 출입국 관리소 관계자는 "연행 과정이라도 폭행 등 불미스러운 일이 일어나지 않도록 직원들에게 교육을 시키고 있는데 (출입국)사무실 안에서 이런 일이 벌어진 데 대해 입이 열 개라도 할 말이 없다"며 "철저한 조사를 벌이고 있다"고 말했다.
한편 서울양천서 경찰관들의 가혹행위를 수사하고 있는 서울 남부지검은 폭행 혐의가 있는 경찰관 4명을 구속기소한 데 이어 인권위가 조사한 가혹행위 피해자 22명 모두에 대해 폭행 피해 여부를 조사하는 등 수사를 확대하고 있다.
2) 인천출입국관리소, 본인 동의 없이 벌금 공제 절도 사건
필리핀 노동자 A씨는 2010년 6월 초에 공장에서 일을 하던 중 함께 일하던 동료 4인과 함께 인천출입국관리사무소에 단속이 됨. 이후 공장의 사장은 그간 지급하지 못했던 급여를 출입국관리사무소 계좌로 일괄입금을 함.
6월9일 인천출입국 측에서는 단속된 A씨외 4인에게 벌금을 납부하겠다는 동의서에 사인을 하라고 함. A씨는 사인을 거부했으나 나머지 4인은 사인을 하였음. 그러자 출입국관리사무소에서는 계좌로 입금한 돈에서 벌금을 공제하였고, 나머지 4인은 본국으로 출국을 함.
A씨는 끝까지 사인을 거부하였으나 출입국 측에서는 벌금 납부를 계속 종용하였음. A씨는 결국 6월 18일 화성보호소로 이송됨. 그러나 보호소로 이송된 후 출입국 측에서는 벌금을 공제하겠다고 통보하며, 이미 동의서에 사인을 한 사실이 있다고 주장.
이러한 내용에 A씨가 수긍하지 않자, 인천에 있는 OO이주민센터에서 인천출입국에 항의를 함. 인천출입국 측은 그제서야 본인에게 사인을 받은 바는 없고 A씨가 다니던 부천의 교회의 목사와 공장사장이 공제해도 좋다고 동의를 해서 공제하였다고 함.
이에 대해 항의하자 이미 벌금을 국고에 환수되어 어쩔 수 없다는 입장임. OO이주민센터에서 A씨에 대해 사과를 하고, 위로금를 지급하라고 하자, 출입국에서는 25일 A씨를 인천출입국으로 이송시킨 후 사과와 위로금조로 비행기티켓과 10만원을 지급한 후 출국시킴.
3) 대구출입국관리소, 체불임금에 대한 벌금 요구 계속
- 필리핀 여성노동자가 단속이 되어서 연락이 됨. 회사에 체불임금을 받을 것이 있는데 출입국에서 벌금을 요구했다고 함. 출입국 확인결과, 임금을 받아 벌금통지서에 싸인을 요구했는데 이 여성노동자가 싸인을 하지 않자, 청주로 보내지 않고 10일정도 대구출입국보호소에 감금시킨다고 했다고 함. 이에 대해 항의를 하자, 대구출입국은 벌금싸인을 받지 않고 청주보호소로 이송함.
- 베트남노동자가 단속이 되어 벌금을 요구함. 체불임금 200만원이 있었고, 사장이 벌금을 들고 출입국에 옴. 그러나 이 이주노동자는 벌금을 요구하는 통지서에 싸인을 하지 않음. 장기간 청주보호소에 구금되어 있어 이주노동자가 괴로워 벌금을 100만원 내겠다고 이야기를 했으나 출입국이 받아주지 않음. 이유는 체불임금 200만원 받았으면서 왜 100만원만 내느냐는 것이었음.
-> 벌금과 관련하여 출입국 확인결과 체불임금을 사업주들이 가지고 오면 출입국에서 수령해 있다가 이주노동자들에게 벌금통지서에 싸인을 요구함. 싸인을 하지 않으면 장기구금시켰다가 출국시킴. 어느 정도의 장기구금인지는 알 수 없으나, 언젠가 출국은 시킨다고 함. 어떻게 체불임금을 받아서 벌금을 내게 하냐고 항의를 하니, 출입국관리법에 벌금조항이 있고, 임금은 직접지불의 원칙이 있기 때문에 싸인을 받는데 싸인을 하지 않으면 자신들도 어쩔 수 없다며 변명한 함.
4) 사업주 조사 미비 이유로 출국 안 시키고 있는 사건
6월 7일 단속된 태국사람이 벌금도 내고 티켓도 끊었는데, 사업주 조사가 안되었다는 이유로 출국하지 못하고 있다고 함.
5) 비자를 갖고 있는 사람에 대해서도 단속한 사건
지난 주 경북성주 소재 한 공장을 단속하기 위해 출입국차량이 공장 앞에 서 있는데 공장을 나오던 이주노동자(스리랑카)가 단속이 되었음.
이 이주노동자는 자신은 비자가 있음을 밝혔고, 지갑속의 ID카드를 확인해보라고 여러 차례 이야기를 했음에도 불구하고 출입국은 아랑곳하지 않고 이 이주노동자를 수갑 채우고 강제로 단속차량에 태웠음. 이 이주노동자는 계속 항의를 함. 그 때서야 출입국에서 조회를 해보고 나서야 비자가 있음을 확인하고 풀어줌. 이주노동자는 출입국직원들에게 사과를 요구함. 그러나 출입국직원들은 윽박을 지르며 "앞으로 조심해"라며 돌려보냄.
6) 기타
- 6월 8일 부천 소사 쪽에서 밤 10시~12시 회사 들어와서 필리핀 10여명 단속.
- 사복경찰이 단지 액세서리 많이 달고 있다는 이유로 길거리에서 단속하고, 가방 뒤져서 물건 많다고 도둑으로 의심해서 물건 산 가게로 가고 집도 수색한 사건 있었음.
- 포천 송우리 지역 매일 단속: 인천, 춘천, 의정부 출입국 등 가리지 않고 실적 채우기 위해 들어와서 단속한다고 함.
- 밤낮을 가리지 않고 단속이 자행되고 있음. 시화, 반월공단의 경우 야간근무를 마치고 퇴근하는 이주노동자를 단속하기 위해 새벽 5시부터 7시 사이에 단속한 사례도 있음.
- 6월 21일 안산역에서 경찰과 출입국 합동 단속. 가방도 열어보는 식으로 검문했다고 함.
집중단속의 문제점 비판
Forced payment of the fines
According to our discussion with the Incheon Immigration chief the fine was not mandatory but voluntary. They said the only purpose of the fine was to reduce the ban from 5 years to 3 years but this is not the case in the detention centers.
Case 1: A migrant woman worker was threatened that she would have to spend more than a month in the detention center if she doesn't pay the fine.
Case 2: 3 Filipinos were arrested, the employer forwarded the money to the immigration office account. The officers asked all three people to sign an acknowledgement letter that they allowed the immigration office to deduct the fine from the money that they received. 2 agreed, one did not. still fine was taken from all three.
to compensate the worker who refused to pay the fine, was given a free airticket and 100k won. the 2 million fine wasn't returned.
Immigration violence
Case 1: In Suwon immigration a chinese detainee was badly beaten up by the immigration officers inside the detention center. Exposed by a news reporter
Police check to the extent of going through the workers belongings.
- incidences of workers checked by the police.
case 1: Undocumented worker randomly checked by police, was found carrying jewelries. Questioned and accused of stealing even upon presentation of receipt. Verified the purchase with the store.
case 2: In Ansan during the evening, two uniformed policemen with two undercover immigration officers were doing random checks on the station turnstile exit. The workers would present IDs but the officers checked the bags as well.
(* will probably claim justification for the check by saying they were searching for deadly weapons. Take note that in some factories they also make use of cutters and small knives)
Immigration tactics of surveillance and baiting
Report have also been gathered as to the means of gathering information and invading the company premises.
case 1: a female immigration officer knocked on the company door/gate. Seeing no apparent threat, the people inside opened the door and then immediately a number of immigration officers ran inside to arrest the undocumented workers
case 2: 1 person went around an industrial complex accompanied with one driver in the southern gyeonggi region. They conducted a surveillance and assessment of the area. One person sneaked around, going to the accomodations and the workplace pretending to be looking for a person or company(the names of the person or the company are fictitious). One person stays in the car parked far away from where the inspection was taking place. They are believed to be immigration officers conducting ocular inspection of the companies determining the number of migrants in the company, whether documented or undocumented and taking note of the exit points in the company. These people were seen going around the entire complex looking for different people and different company names each time. they also went in to check some of the accomodations.
Enforced Institutional Racism
-Policy(Crackdown, EPS, Immigration control law, etc.) declares it legal to enforce racism.
-Any foreign-looking person can be stopped and asked for identification and searched for no apparent reason or premise.
-they immediately label migrants as potential criminals.
-deliberate acts of suppression and discrimination towards a cultural minority
evident in institutions such as police agencies, immigration offices, labor offices, etc.
Repression
-Even before dispatching from home countries to korea, during the pre-departure orientation and training workers are told not to join unions because it is illegal and they will be subjected to instant deportation. (ex)
-In some countries they are required to sign a waiver form that would rescind their 3 basic labor right. (ex)
-The total lack of consideration towards migrants rights and welfare both in the policy and the institutions are obviously the standard operating procedure in institutions like the Ministry of Labor(Job Centers, Labor offices) and the Immigration office. (ex)
-the visa status of the workers always remain precarious. Lost due to negligence or malicious intent of the employer, other factors that is not necessarily due to the fault of the worker
Divide and rule
- Apparently it worked to their advantage to take multiple nationalities in Korea. In that sense, workers would have a more difficult time organizing themselves to work together to improve the conditions. Cultural and language differences plays a huge role in keeping the workers divided.
- The government brainwash people into thinking that migrants are competitors to the local workers and migrants are competitors to each other.
- They raise fear and aversion to migrants by propagandizing against migrants as criminals, low educated, dirty and has violent tendencies.
The undocumented migrant are especially vulnerable to these human rights violation and at some point victims of criminal acts. They have no access to justice specially if the offender is a government officer or institution. There are numerous incidences that we have been able to record or were reported to us but gathering evidence proves to be such a challenge. We have no idea how much more incidences go by unreported because of the restriction in visiting detainees. Unless a report has been made we are not able to document most of these offenses.
